GENERAL TERMS AND CONDITIONS OF SALE (GTC)

1. PREAMBLE The website www.ube-nolia.com is operated by SUPRA TRADING, SL, registered in the Spanish Commercial Register under number B75301903, with its registered office at Cl Benet Cortada N-55-59, Local 6, 08174 Sant Cugat Del Valles, Spain. Contact email address: bonjour@ube-nolia.com.

These General Terms and Conditions of Sale (GTC) govern all sales made on the website, in accordance with French consumer law.

2. PRODUCTS The products presented are described and displayed as accurately as possible. However, errors or omissions may occur. Photographs are not contractually binding.

3. PRICES Prices are indicated in euros including all taxes. The applicable VAT is that in force at the time of the order. Delivery costs are indicated before final confirmation of the order.

4. ORDER The customer declares that they have read the GTC before placing an order. Confirmation of the order implies unreserved acceptance of these GTC.

5. PAYMENT Payments are secured via Shopify's payment providers. Payment is due immediately upon placing the order.

6. DELIVERY Products are shipped to the address provided by the customer when placing the order. Delivery times are estimated and may vary depending on the destination. In the event of a delay, the customer will be notified by email.

7. RIGHT OF WITHDRAWAL In accordance with Articles L221-18 et seq. of the French Consumer Code, the customer has a period of 14 calendar days from receipt of the order to exercise their right of withdrawal, without having to justify their reasons or pay a penalty.

However, in accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to products that have been opened, unsealed or consumed after delivery by the customer, for reasons of hygiene and health protection.

Products must be returned in their original packaging, unopened and in perfect condition. Return costs are the responsibility of the customer. In the event of a valid withdrawal, the refund will be made within 14 days.

8. WARRANTIES The customer benefits from the legal guarantees of conformity (Articles L217-3 et seq. of the Consumer Code) and the guarantee against hidden defects (Articles 1641 to 1649 of the Civil Code).

9. LIABILITY SUPRA TRADING SL cannot be held liable in the event of non-performance or poor performance of the contract due to the customer, the unforeseeable and insurmountable actions of a third party, or a case of force majeure.

The customer is solely responsible for the use they make of the products purchased. SUPRA TRADING SL cannot be held liable for any use that does not comply with the recommendations for use, local regulations or for non-food purposes.

SUPRA TRADING SL reserves the right to refuse any abusive, repetitive or bad faith orders or claims, after informing the customer.

10. PERSONAL DATA The information collected is processed in accordance with Regulation (EU) 2016/679 (GDPR). Customers have the right to access, rectify, transfer and delete data concerning them. To exercise these rights, please contact: bonjour@ube-nolia.com

11. INTELLECTUAL PROPERTY All content (text, images, graphics, logos) is the exclusive property of SUPRA TRADING SL. Any reproduction or use without written authorisation is prohibited.

12. RETENTION OF TITLE The products remain the exclusive property of SUPRA TRADING SL until full payment has been made by the customer.

13. PROOF OF TRANSACTIONS The data recorded on the website www.ube-nolia.com and on the payment platforms are binding between the parties and constitute proof of the transactions.

14. APPLICABLE LAW AND DISPUTES These GTC are governed by Spanish law. However, in accordance with Regulation (EC) No. 593/2008 (Rome I), consumers residing in another European Union country also benefit from the mandatory provisions protecting the law of their country of residence.

In the event of a dispute, an amicable solution will be sought as a priority. The customer may have recourse to a consumer mediator free of charge. If no amicable agreement can be reached, the dispute may be brought before the competent court of the consumer's place of residence or the registered office of SUPRA TRADING, SL if the customer is a professional.
